Distance Selling Contract

This contract is signed by Keşif Alanı Danışmanlık Turizm Sanayi ve Ticaret LTD. Şti. (referred to as Keşif Zone Eco Resort & Retreat in the contract) and the person who is a member of www.kesifzone.com and completes the online reservation process (referred to as the CONSUMER in the contract). The address, identity and contact information used by the consumer while becoming a member is taken as basis.

1- The consumer who purchases accommodation through our site is obliged to pay the entire service fee at the time of booking. The reservation will not be finalized until the full payment is made. In case of partial payment, reservation cannot be claimed and accommodation is not requested. The refund of the consumer who makes a partial payment is returned in the same way within 60 working days. The consumer cannot claim any rights other than a refund.

2- In case of a price increase in the contract price, the difference will not be claimed from the consumer, and the discounts, which are called action by SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat, are not refunded to the consumer.

3- In case it is not possible for the consumer to participate in the purchased accommodation service, he may transfer his reservation to a third party who will fulfill all the conditions applicable to the contract by notifying SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat at least 30 days before the accommodation start date. In this case, the person(s) who transferred and took over the contract are jointly responsible for the payment of the balance amount against SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat and all additional expenses arising from the transfer. SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat does not accept any responsibility and collects the entire accommodation fee from the transferor and the transferee (several and several) in the event that the consumers do not have a visa or can not obtain a visa from the relevant institution until the start of the accommodation despite having made an application. In the event that the person transferring the service is not in the same status as the transferor, the transfer does not take place or the transfer process is completed by removing the special discounts made.

4-SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat may partially/completely change or cancel the reservation before or during the service for a reason not caused by the consumer. The consumer can accept these changes or accept another alternative service offered by SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat. If the consumer does not accept the changes, he has the right to cancel the reservation and receive a full refund of the fee paid under the contract. Although SEYDIKEMER/FETHIYE Discovery Zone Eco Resort & Retreat has shown all due diligence, it is an obstacle to the start or continuation of the service; The reservation may be canceled or postponed due to strike, terrorism, possibility of war, unpredictable technical issues and all these and similar force majeure reasons. In cancellations made by the consumer up to 30 days from the start of the stay, 80% of the price paid is returned to the consumer, excluding the costs arising from compulsory taxes, fees and similar legal obligations. If the consumer requests a cancellation up to 15 days from the start of the stay, 50% of the contract price is returned to the consumer. The consumer declares, accepts and undertakes to pay the entire contract price to SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat, if he or she requests a cancellation made less than 15 days before the start of the stay. In case of the consumer's request for a change in the service, provided that this change is approved by SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat, if there is a price difference between the previously purchased service and the newly requested service, the consumer will immediately pay the difference to SEYDIKEMER/FETHIYE Keşif Zone, upon the acceptance of the change request. Must pay to Zone Eco Resort & Retreat. However, if the price of the new service is lower than the price of the previous service, SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat is not obliged to pay the difference to the consumer. Reservation cancellation request is accepted, provided that the consumer certifies his or her first degree relatives' discomforts that prevent at least 30 days of habitual occupation, which coincides with the accommodation period, with an official report from the Fully Equipped State Hospital or in case of death, and the request for cancellation of the reservation is accepted and arising from the obligatory taxes, fees and similar legal obligations. The price paid by the consumer is returned to him within 60 working days, excluding the costs and the non-refundable costs that can be paid and documented to third parties. In this case, the report and documents will be submitted before the start of the service. In case the consumer does not notify in writing that he will participate in the accommodation service that he missed the beginning of; SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat has the right to cancel all reservations and services made on behalf of the consumer after 24 hours. No refund will be made to the consumer for such cancellations. In case of reservation, the rooms are determined by SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat. The consumer cannot claim a right in this regard.

5- SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat and the consumer will duly fulfill their obligations arising from this contract.

6-SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat, işbu sözleşme konusu hizmetin nitelikleri, satış bedeli ve ödeme şekli ile ifaya ilişkin ön bilgiler içeren Ön Bilgilendirme Formu/Voucherı/Mailini tüketiciye sözleşmenin 8.maddesinde belirtildiği şekilde iletmekle yükümlüdür. Tüketiciden kaynaklanan durumlar ile üçüncü kişilerin şahsi sorumluluklarından kaynaklanan hallerden SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat sorumlu değildir.

7- Consumers who purchase service with a credit card are required to notify the bank to which the card belongs to their early payment and installment reduction requests and to make them to the payment branches determined by the bank. When the consumers cancel the service they have purchased with their credit card in installments for any reason, SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat will refund the amount received from the credit card to the consumer's credit card. The refund is returned to the consumer's card in accordance with the business rules of the banks. Bank rules are also valid for refunds regarding payments made in installments, and SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat does not have any obligation or opportunity to intervene if payments made in installments are returned to the card in installments.

8- SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat will be able to make all notifications to the consumer in written form or through a permanent data provider (e-mail, short message, disc, cd/dvd, memory card and any similar tool or medium). The consumer is obliged to notify SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat, within 3 days from the date on which the service should be performed or when the contract is not performed at all or as required due to the duty of care. Notifications made after this period will be deemed invalid. The consumer has given to SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat employees and/or websites during the reservation; e-mail, mobile phone, fax etc. accepts and declares that it allows the newsletters sent by SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat and websites for campaign announcement purposes. SEYDIKEMER/FETHIYE Keşif Zone Eco Resort & Retreat undertakes to terminate e-mail, sms, fax and postal mailings if the consumer declares that they do not want notifications and announcements made to their communication channels.

9-SEYDIKEMER/FETHIYE Enforcement Office and Courts are authorized to resolve all disputes arising from this contract. If one or more of the articles of the agreement are deemed invalid for any reason, the other provisions of the agreement will not be affected by this invalidity and will remain in effect. This contract has been drawn up in accordance with the provisions of the Law No. 6502 on the Protection of Consumers, and the provisions of the Law No. 6502 and the relevant regulation are valid for matters not regulated in the contract. The consumer shall be deemed to have accepted and committed to the terms of the contract by signing this contract/approving it electronically.
